Terms of Use

Via: Calorie Counter & Diary · Effective October 20, 2026

These terms are the agreement between you and the maker of the Via app (“Via”, “the app”): Dzmitry Dziabel (Steel Berries), a sole proprietorship registered in Poland — ul. Nowy Świat 33 lok. 13, 00-029 Warszawa, Poland, NIP 5252969453, REGON 526168519 — “we” in these terms. Contact: info@steelberries.com.

By installing or using Via you accept these terms. How the app handles your data is described in the privacy policy, which is part of them.

The short version

  • Via is not medical advice. Its calories, targets, macronutrients, dates and AI estimates are approximations and can be wrong.
  • It is for healthy adults losing weight or maintaining it. You must be 18 or older. If you are pregnant or breastfeeding, have or had an eating disorder, or are on a prescribed diet or under medical care for your weight, talk to a doctor instead.
  • Via Pro is a subscription sold by Apple and Google. It renews automatically until you cancel it in the store, and refunds go through the store.
  • Your diary lives on your phone. We have no copy of it and can’t restore it.
  • Use it fairly. Don’t scan what isn’t yours to share, and don’t try to get around limits or purchase checks.

1. Not medical advice

Via is a diary and a calculator for adults who want to lose weight or maintain it. It is not a medical device and does not diagnose, treat or prevent any condition. Everything it shows is an estimate made from standard formulas and from what you enter: your daily calorie target and burn, macronutrients, water goal, the pace and the date by which you may reach your goal, and the calories and macronutrients of a scanned meal. Bodies differ, entries are incomplete, and the AI scanner makes mistakes — these figures can be wrong, sometimes by a lot. Check a scanned meal before you save it.

Via plans only weight loss and weight maintenance. It does not build a weight-loss plan when your weight is already low for your height, and it never sets a daily target below a safe minimum. These safeguards are not a substitute for a doctor.

Via is not designed for you, and you should follow a doctor’s advice rather than the app, if you:

See a doctor before starting a weight-loss plan if you are unsure whether it is safe for you, and stop and seek medical help if you feel unwell.

2. Age

You must be 18 or older to use Via. The app asks for your date of birth and does not create a plan for anyone younger.

3. Free features and Via Pro

The diary, your plan, Path to Goal, weigh-ins and reminders are free. The free version also includes a limited number of AI scans and of saved dishes, workouts and folders. The current limits are shown in the app; we may change them, and the free scans are a one-time allowance, not a monthly one.

Via Pro adds unlimited AI scans, the water tracker, and unlimited saved dishes, workouts and folders. It is an auto-renewing subscription, yearly or monthly, sold through the App Store or Google Play.

When Pro ends, nothing you created is deleted. Dishes, workouts and folders beyond the free limits stay and keep working, but you can’t add new ones past the limits; the water tracker locks again, and the water you logged stays on your phone; AI scans fall back to the free allowance.

Purchases are also governed by the store’s own terms — Apple’s Media Services Terms and Conditions or the Google Play Terms of Service. Apple and Google are not parties to these terms (sections 10 and 11).

4. The AI meal scanner

When you scan a meal, the photo or description you submit is sent to our server and on to our AI provider, OpenAI, to recognize the food and estimate its calories and macronutrients. The privacy policy (section 2) explains what is sent and how long it is kept. The scanner needs an internet connection and may be slow or unavailable at times.

When you use the scanner, you agree:

The scanner’s answers are estimates (section 1), and you decide what is saved. We may limit or suspend scanning for an installation that breaks these rules, and Pro does not lift the limits that protect the service from abuse.

5. Your data and backups

Your diary, weigh-ins, profile, plan, saved dishes and workouts, and settings are stored only on your phone. Via has no accounts and no sync, and we have no copy of your data, so we can’t recover it if it is lost. Your phone’s own backup — Google’s Android backup or Apple’s iCloud or computer backup — may include it; keeping a backup is up to you.

Settings → Reset all data permanently deletes everything stored in the app on that phone, and so does uninstalling it. It can’t be undone, and it does not cancel a subscription.

What you enter remains yours. You let us process what you submit to the scanner only to provide the service, as described in the privacy policy.

6. Your license to use Via

We give you a personal, non-exclusive, non-transferable, revocable license to install and use Via on devices you own or control, for your own non-commercial use, under these terms and the rules of the store you got it from. You may not:

The license ends automatically if you break these terms. You can stop using Via at any time by deleting it — remembering to cancel any subscription in the store.

7. Intellectual property

Via — its code, design, text, illustrations, icons and the name and logo of Via and Steel Berries — belongs to us or our licensors and is protected by copyright and other laws. These terms give you no rights to it beyond the license in section 6.

8. Changes to the app

We keep improving Via and may add, change or remove features. Some features need our server and may be interrupted for maintenance or by outages. If we remove or materially reduce a feature you are paying for during a paid period, your rights under consumer law apply.

9. Warranties and liability

Nothing in these terms limits your statutory rights as a consumer, including your right under the law of your country to digital content and services that conform to the contract, or our liability for harm caused intentionally or by gross negligence, or for death or personal injury where the law does not allow it to be limited.

Within those limits: Via is provided “as is” and “as available”. We don’t promise that it will be uninterrupted or error-free, that its estimates are accurate, or that you will reach any particular weight or result. We are not liable for decisions you make about your diet, health or exercise based on the app, for data lost from your phone, or for indirect or consequential loss. Where the law allows it, our total liability to you is limited to what you paid for Via Pro in the 12 months before the claim.

10. If you got Via from the App Store

These terms apply in addition to the rest of this page when you use Via on an Apple device:

11. If you got Via from Google Play

These terms are between you and us, not with Google. Your use of Google Play and purchases made through it, including Via Pro, are also governed by the Google Play Terms of Service and Google Play’s policies, including its refund policy. Google has no obligation to provide support for Via.

12. Changes to these terms

We may update these terms — for example when the app, the law or the stores’ rules change. We will publish the new version on this page with a new date and, if a change materially affects you, publish it at least 14 days before it takes effect. If you don’t agree with the new terms, stop using Via and cancel any subscription; using it after a change takes effect means you accept the new terms.

13. Law and disputes

These terms are governed by Polish law. If you are a consumer, you also keep the protection of the mandatory consumer laws of the country where you live, and you may bring a claim in the courts there or in Poland.

If something is wrong, please write to us first at info@steelberries.com — we answer complaints within 14 days. If any part of these terms is found invalid, the rest stays in force.
